When to Use a Higher-Level Review

Use an HLR specifically when you believe the original decision misapplied the law, misread the facts, or overlooked evidence that was already in your file — not when you have new evidence to add. That distinction is the entire point of this lane: it's a fresh, more senior review of exactly what was already there, conducted without the addition of any new material.

Common Grounds for an HLR

• The rater misread or ignored evidence already in the file
• The wrong diagnostic code was applied to the claimed condition
• The effective date is clearly incorrect based on the filing history
• A Duty to Assist error — the VA failed to obtain records or schedule an exam it was obligated to provide

Use it to explain the specific error clearly and directly — this is one of the highest-leverage, lowest-cost moves available anywhere in the VA appeals system, and there's genuinely no downside to requesting it.

Timeline and Outcomes

HLRs average 4 to 5 months from filing to decision. The outcome can affirm the original decision, reverse it outright, or remand the issue back for additional development if the reviewer identifies a gap that needs to be filled first.
